Based on the overview of Tax Information Exchange Agreements (TIEAs) concluded by Poland, as provided on the website of the Polish Ministry of Finance, it can be concluded that the TIEA as concluded between the Government of the Republic of Poland and the Government of Bermuda entered into force on March 15, 2015.

 

Based on Article 3 of the agreement the taxes which are the subject of this Agreement are: 

(a)   in the case of Poland:

(i)     the personal income tax;

(ii)    the corporate income tax; and

(b)   in the case of Bermuda:

Direct taxes of every kind and description.

 

Paragraph 2 of Article 3 furthermore determines that the Agreement shall apply also to any identical or substantially similar taxes imposed after the date of signature of the Agreement in addition to, or in place of, the existing taxes. The competent authorities of the Contracting Parties shall notify each other of any substantial changes in their laws which may effect the obligations of that Contracting Party pursuant to this Agreement.

 

Based on Article 12, paragraph 2 of the Agreement the fact that the agreement entered into force on March 15, 2015 means that it shall have effect for requests made on or after the date of entry into force

(a)   for criminal tax matters on that date; and

(b)   for all other matters covered in Article 1 on that date but in respect of taxable periods beginning on or after that date, or where there is no taxable period, all charges arising on or after that date.
