On April 28, 2015 an announcement was published in the “Tractatenblad van het Koninkrijk der Nederlanden” stating that the Agreement between the Kingdom of the Netherlands, in respect of the Netherlands Antilles, and Bermuda (as authorised by the Government of the United Kingdom of Great Britain and Northern Ireland) for the Exchange of Information with respect to Taxes entered into force on March 24, 2015.

 

According to the announcement published, for the Netherlands the Agreement applies to Bonaire, Sint Eustatius, Saba, Curaçao and Sint Maarten.

Please note that earlier the Dutch Government published some announcements stating that the following corrections were made to the English text of the Agreement:

·        In Article 6, Paragraph 1, third line the word “applicant” has to be replaced by “requested”. After this correction Article 6, Paragraph 1 of the Agreement reads as follows: “The requested Party may allow, to the extent permitted under its domestic law, representatives of the competent authority of the applicant Party to enter the territory of the requested Party to interview individuals and examine records with the written consent of the persons concerned. The competent authority of the applicant Party shall notify the competent authority of the requested Party of the time and place of the meeting with the individuals concerned.

·        In the third paragraph of the Preamble to the Protocol “United Kindom” has to be replaced by “United Kingdom”.
