On June 10, 2016 the Swiss Federal Council adopted a dispatch on amending the Tax Administrative Assistance Act for the attention of Parliament. The amendment arranges that the Swiss practices with respect to stolen (tax) data are to be eased.

 

If the Swiss Parliament agrees on the amendment, it should become possible for the Swiss authorities to respond to requests if a foreign country obtained the stolen data via normal administrative assistance channels or from public sources. However, administrative assistance will still not be possible if a country actively acquired the stolen data outside of administrative assistance proceedings.

 

In a press release published on the website of the Swiss Federal Department for Finance it is stated that Swiss practices were increasingly being called into question by numerous countries and by the Global Forum. With the proposed legislative amendment, the Federal Council is clarifying the legal situation and taking account of both international requirements and the Global Forum's recommendations with regard to administrative assistance in tax matters.
