On October 28, 2016 the Dutch Minister of Finance sent the Dutch Parliament an annotated agenda for the Eurogroup meeting of November 7 and for the Economic and Financial Affairs Council of November 8.

According to the Dutch Minister of Finance a.o. the following tax items will be on the agenda of the ECOFIN meeting: 

·   The plans of the European Commission to overhaul the way in which companies are taxed as presented on October 25, 2016;

·   Financial Transaction Tax;

·   Criteria and process leading to establishing a common list of jurisdictions that are non-cooperative in the field of taxation.

 

Plans of the European Commission

According to the Dutch Minister the European Commission will give a presentation regarding the Commission’s plans to overhaul the way in which companies are taxed as presented on October 25, 2016. The Dutch Minister furthermore adds that the following documents will be discussed:

·   (2016)683 – proposal Directive on a Common Consolidated Corporate Tax Base (CCCTB)

·   (2016)685 – proposal Directive on a Common Corporate Tax Base

·   (2016)686 - proposal Directive for a Double Taxation Dispute Resolution Mechanisms in the European Union

·   (2016)687 - amending Directive (EU) 2016/1164 as regards hybrid mismatches with third countries

 

Financial Transaction Tax

Furthermore according to the Dutch Minister of Finance the ECOFIN is expected to discuss the state of play regarding the enhanced cooperation for a Financial Transaction Tax (FTT).

 

According to the Dutch Minister the 10 Member States participating in the FTT have recently indicated that the came to a basic consensus which can be used for developing a full directive. The Dutch Minister emphasizes that no final agreement has been reached yet. During the ECOFIN meeting the FTT Group will present its basic consensus to the other Member States.

 

List of non-cooperative tax jurisdictions

According to the Dutch Minister of finance the Council is expected to adopt council conclusions regarding the criteria and the process for drafting a common EU list of jurisdictions that are non-cooperative in the field of taxation. With the support of the European Commission the Member States have drawn up a long list based on economical and juridical criteria. According to the Dutch Minister of Finance the council conclusions the ECOFIN is expected to adopt will elaborate on the juridical criteria that are going to be used for drawing up the final list.
