(June 17, 2015)

Earlier today we reported on the European Commission’s Action Plan for Fair and Efficient Corporate Taxation in the EU that was presented on June 17, 2015. In relation thereto, to launch a more open and uniform EU approach to non-cooperative tax jurisdictions, the Commission has published a pan-EU list of third countries and territories blacklisted by Member States. One of the countries mentioned on this list is Liechtenstein.

In a reaction the Government of Liechtenstein published a press release on which it calls on the European Commission to take the necessary steps to arrange that Liechtenstein will no longer appear on any EU-list of uncooperative countries and to assure that the still existing unjustified tax discrimination will be eliminated.

Liechtenstein rejects the accusations of a lack of cooperation in tax matters and refers to the already existing close cooperation with the EU in tax matters and its commitment to current international standards.

According to the press release the qualification of Liechtenstein as an uncooperative State towards the EU or its Member States is unfair and unacceptable. The Government of Liechtenstein is therefore of the opinion that taking into account the already very advanced state of negotiations and talks with the EU on the implementation of the automatic exchange of information and on a further dialogue on taxation of corporations, the announcement of the European Commission about its intentions to include Liechtenstein as one of the countries that are uncooperative with the EU in combating tax avoidance, is completely unjustified.
